In some instances, with your explicit consent or as permitted by law (e.g., consistent with FERPA for formal school partnerships), we may receive information from educational institutions. If you choose to connect a third-party Single Sign-On (SSO) service, we may receive certain data from that provider as authorized by you.

C. Information Collected Automatically (Automatic Data Collection): When you access our services, we automatically log certain data to facilitate service delivery, enhance user experience, and for analytical purposes. This includes:

  • Device Data: Operating system, browser type, IP address, general location information.
  • Online Activity Data: Pages viewed, navigation paths, access times, interaction with website features.
  • Technical Data: Log-in data, browser plug-ins. This collection is facilitated by cookies and similar technologies, as detailed in our Cookie Policy (Section 7).

  • Educational Information: Tutoring session records, diagnostic results, learning progress, assessments, coursework, specific learning needs or preferences, and any academic information provided by parents or (with consent) from schools.
  • Student Profile Data: School name, grade level, subject interests.
  • Service Personalization Data: Preferences set in your profile for topics, content, or types of tutoring.
  • Communication Interaction Data: Engagement with emails or other communications (e.g., opens, clicks).
  • Payment Data: Name on card, billing address, expiration date. Sensitive payment card numbers are processed directly by secure third-party payment service providers (e.g., Stripe), and we only receive confirmation of payment and typically the last four digits of your card number.
  • Analytics Data: Internet log information and user behavior patterns from analytics tools.
  • Technical Data: Browse activity, IP address.


2. How We Use Your Information


We use the collected personal information primarily to deliver personalized tutoring services, communicate effectively with our users, process payments, enhance service quality, and ensure the security of our platform. Our data usage is guided by core privacy principles:

A. Limited & Necessary Disclosures for Service Operations:

  • With Tutor: Educational information and relevant personal details are shared with our qualified tutor solely for the purpose of providing tutoring services, managing your account, and improving our educational offerings. All personnel are bound by strict confidentiality agreements.
  • Payment Processors: Necessary payment information (excluding full credit card numbers, which are directly handled by the processors) is shared with trusted third-party payment service providers for secure transaction processing.
  • Technology Providers: We utilize reputable third-party technology providers for essential services, such as virtual classroom platforms (e.g., MobyMax, Pencil Spaces, and/or Zoom), CRM or LMS systems (e.g., Wise), and cloud hosting. These providers are carefully selected for their security and privacy standards and are contractually restricted from using your personal information for any purpose other than providing the services to EXCELerated Success.
  • Educational Partners (Under Contract): In some cases, student educational data may be shared with educational institutions (e.g., schools) under explicit contractual agreements that comply with FERPA and other applicable privacy laws. This only occurs with appropriate consent or as otherwise permitted by law.

B. Single Sign-On (SSO) Services: If you choose to log in to our services via a third-party SSO provider (e.g., Google), certain Identity Data, Contact Data, and Service Personalization Data may be exchanged with that provider to facilitate your login.

C. Other Disclosures:

  • Legal Compliance and Protection: We may disclose information if required to do so by law, subpoena, court order, or if we believe it is necessary to protect the rights, privacy, safety, or property of EXCELerated Success, our users, or others. EXCELerated Success is an online service directed to children under 13, and we are fully committed to protecting their online privacy by strictly complying with COPPA.

5. Family Educational Rights and Privacy Act (FERPA) Compliance


While FERPA primarily applies to educational agencies and institutions receiving federal funds, EXCELerated Success is committed to upholding the spirit of FERPA by diligently protecting the privacy of student education records to the extent applicable to an online tutoring business.

  • Education Records: Information directly related to a student and maintained by EXCELerated Success (e.g., session records, progress reports) may be considered an "education record" under FERPA principles.
  • Parent and Eligible Student Rights: To the extent applicable, parents and eligible students (students 18 years or older, or attending a postsecondary institution) have specific rights concerning education records, including: 
    • The right to inspect and review the student's education records within a reasonable timeframe (not exceeding 45 days).
    • The right to request amendment of education records that they believe are inaccurate or misleading.
    • The right to consent to disclosures of personally identifiable information from education records, except where FERPA authorizes disclosure without consent (e.g., to school officials with legitimate educational interests, or in response to a subpoena).
  • Disclosure of Information: We will not disclose personally identifiable information from student education records without appropriate consent, except as permitted by law or as described in this privacy policy (e.g., to third-party service providers who assist us in providing our services and are bound by confidentiality obligations, or to an educational institution as part of a contractual agreement).

The specific retention periods vary depending on the type of information and its purpose.

Upon expiration of the retention period, personal information will be securely deleted or anonymized.
